The Ivy Membership Site- Legal Terms
Welcome to The Ivy Collection’s Membership scheme.
- 1. This agreement sets out the terms and conditions (Terms) that governs your use as a registered account holder (Member or Membership) of The Ivy Collection App scheme (referred to as the Ivy App) including all services (Ivy
Membership Services) provided through the Ivy App and the Ivy Collection membership website www.theivycollection.app (together the Ivy Membership Site). For full details on our Terms of Use and Terms of Service please see Part 1 and
Part 2 below. The Ivy Membership Services are operated by Troia (UK) Restaurants LTD, 26-28 Conway Street, London, W1T 6BQ. - 2. Please note, we offer the Ivy Membership Site and Ivy Membership Services free of charge.
- 3. In addition to the above, Parts 3 and 4 below set out our Privacy Policy and Cookie Policy. It is here that you will find out your and our respective rights and obligations in connection with applicable data protection
laws when registering as a Member. If you choose to use the Ivy Membership Site, our Privacy Policy and Cookie Policy apply and form part of these Terms. - 4. Please note that your access and use of the Ivy Membership Site and Ivy Membership Services are subject to these Terms and by using the Ivy Membership Site you agree to be bound by them. We amend these Terms from time to
time. Every time you wish to use the Ivy Membership Site, please check these Terms to ensure you understand the terms that apply at that time. These terms were most recently updated in June 2023. - 5. Finally, we may update and change the Ivy App and/or website from time to time to reflect changes to the Ivy Membership Services, our Members’ needs and/or our business demands. We will try to give you reasonable notice of

Terms of Use
Please read these terms and conditions carefully before using The Ivy Membership Site.
- 1. Becoming a Member
- 1.1. To become a Member please go to the Ivy App (for Android™ or iPhone® device) and follow the prompts to create an account. You will be required to provide the following information:
- 1.1.1. first and last name, password, mobile phone number, email address and marketing preferences;
- 1.1.2. birthday (month, day and postcode (this information is optional to receive any birthday rewards we may be offering and localised offers).
- 1.2. Your Membership will be automatically activated once you have successfully registered for an account with us. Your account details should then be available on our bookings and reservations system and we should have full
access to your transactional history . Please note, it is your responsibility to ensure that any registration details that you submit are accurate and to establish that your account is active. You can check this by signing into the
Ivy Membership Site or by contacting the Ivy Collection App Help Desk ([email protected]) to raise a support ticket. - 1.3. Please note that any accounts which are not active shall not be entitled to any points, rewards and/or any other Membership benefits. Furthermore, any potential points that you could have earned prior to your account
being activated will be forfeit. - 1.4. By becoming a Member you agree to:
- 1.4.1. not use the Ivy Membership Site for unlawful purposes, including but not limited to sending or storing any unlawful material or for fraudulent purposes;
- 1.4.2. only use the Ivy Membership Site for your sole, personal use and will not resell it to a third party;
- 1.4.3. not assign or otherwise transfer your account to any other person or legal entity;
- 1.4.4. not use the Ivy Membership Site to cause annoyance, inconvenience or nuisance;
- 1.4.5. not authorise others to use your Membership;
- 1.4.6. not copy, or distribute the Ivy Membership Site or other Ivy Content without our prior written consent; and/or
- 1.4.7. provide us with whatever proof of identity we may reasonably request.
- 2. Age requirement
- Membership is only available to persons aged 18 and over.
- 3. 3. Membership, passwords and security
- 3.1. It is your responsibility to ensure your equipment (mobile, computer or any other electronic device) meets any technical specification that may be required to access and use the Ivy Membership Site.
- 3.2. Any registration details (e.g. username and password) that you use as part of our security process, must at all times be treated as confidential and you must not disclose them to anyone else. You will be responsible
for all activities and transactions that take place via your account and you must immediately notify us of any unauthorised use or other security breach. - 3.3. You are required to notify us of any change of address or other personal details. Please note we will not be responsible for any loss of points resulting from you failing to notify us of any change in personal details
(including contact details). - 3.4. No employee of Troia (UK) Restaurants LTD (or any other associated group company) is eligible for a Membership (Employee).
- 3.5. It is strictly prohibited for you to have more than one membership of The Ivy Collection App. Your Membership is non-transferrable and may not be accessed by, sold to, combined with the membership of, or otherwise dealt
with by, anyone else. We may immediately suspend or terminate your Membership if we have reason to believe that you have breached any part of these Terms, including (but not limited to):- 3.5.1. holding multiple Memberships;
- 3.5.2. being an Employee;
- 3.5.3. allowing any third party to access or use your Membership; and/or
- 3.5.4. providing inaccurate or fraudulent information in connection with your use of the Ivy Membership Site or otherwise in connection with your Membership.
- 3.6. If for whatever reason your Membership is terminated, then we may, without limitation:
- 3.6.1. cancel any pending, current or future points, rewards, promotional account credits and/or any other unredeemed vouchers that are associated with your Membership; and
- 3.6.2. reject or prevent you from joining the Ivy Membership scheme under a new account.
- 3.7. We reserve the right to suspend any account, at any time (at our discretion), if you have failed to comply with any of these Terms. In the case of misuse all Memberships of persons involved may be deleted along with any
associated points and rewards, this may also include a ban from visiting any restaurant operated by Troia (UK) Restaurants LTD. - 4. Conditions of use
- 4.1. Unless otherwise set out in these Terms, you may not use the Ivy Membership Site (or any part thereof):
- 4.1.1. in any way that breaches any applicable local, national or international law or regulation;
- 4.1.2. in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;
- 4.1.3. to interfere with or in any way disrupt the integrity and/or performance of the Ivy Membership Site or any content or data contained therein;
- 4.1.4. to send, knowingly receive, upload, download, use or re-use any material which does not belong to you or that you have no right to use;
- 4.1.5. to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
- 4.1.6. to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code
designed to adversely affect the operation of any computer software or hardware; - 4.1.7. to launch any kind of automatic or manual device, process, or means to access, copy, search, or monitor any portion of the Ivy Membership Services or Ivy Content;
- 4.1.8. to launch an automated program or script, including, but not limited to, web spiders, web crawlers, web robots, web ants, web indexers, bots, viruses or worms, or any program which may make multiple server
requests per second, or unduly burdens or hinders the operation and/or performance of the Ivy Membership Site; - 4.1.9. to license, sub-license, sell, resell, transfer, assign, provide, distribute or otherwise commercially exploit or make available to any third party the Ivy Membership Site in any way;
- 4.1.10. to modify and/or make derivative works based upon the Ivy Membership Site; and/or
- 4.1.11. to reverse engineer or access the Ivy Membership Site in order to:
- (a) design or build a competitive product or service;
- (b) design or build a product using similar ideas, features, functions or graphics of the Ivy Membership Site; or
- (c) copy any ideas, features, functions or graphics of the Ivy Membership Site.
- 4.2. Furthermore, you agree not to access without authority, interfere with, damage or disrupt:
- 4.2.1. any part of the Ivy Membership Site;
- 4.2.2. any equipment or network on which the Ivy Membership Site is stored or hosted;
- 4.2.3. any software used in the provision of the Ivy Membership Site; or
- 4.2.4. any equipment or network or software owned or used by any third party.
- 4.3. By using the Ivy Membership Site, you hereby acknowledge that whilst we do no have an obligation to monitor your access to or use of the Ivy Membership Site or review or edit any Member Generated Content, we will have
the right to do so for the purpose of operating the Ivy Membership Site to ensure compliance with these Terms and/or applicable law or as otherwise required by an order or requirement of a competent court or other judicial body. We
reserve the right, at any time and without prior notice, to immediately remove or disable your Membership (without any liability) if we, in our sole discretion, consider you to have breached any of these Terms. - 5. Member Generated Content
- 5.1. The Ivy Membership Site at times may allow you to submit, transmit, post or otherwise provide content including (without limitation) reviews, comments, ratings, photos, images, text data, links and location information,
send emails and other communications and submit suggestions, question, ideas and other information (Member Generated Content). - 5.2. Member Generated Content must be unbiased and objective and not:
- 5.2.1. be illegal, obscene, threatening, inciteful of violence or hatred, discriminatory (on any grounds), racist, defamatory, likely to cause anxiety or embarrassment, be knowingly false or misleading or in any way
not be in compliance with applicable laws; - 5.2.2. contain, transmit or distribute any unsolicited or unauthorised advertising, marketing or promotional material (including any sponsored or paid reviews if the sponsorship or payment is undisclosed in the
material) or be “spam” in any kind of form (including, but not limited to, political campaigns, chain letters, and mass mailings); - 5.2.3. impersonate any person or entity, or otherwise mislead or misrepresent as to the origin of the Member Generated Content;
- 5.2.4. in any way infringe any intellectual property rights or data protection, privacy or other rights of any other person; and/or
- 5.2.5. transmit software, any virus and/or other code that has destructive elements.
- 5.2.1. be illegal, obscene, threatening, inciteful of violence or hatred, discriminatory (on any grounds), racist, defamatory, likely to cause anxiety or embarrassment, be knowingly false or misleading or in any way
- 5.3. By submitting any reviews, ratings, comments or including any other Member Generated Content through the Ivy Membership Site, you grant us and our group a non-exclusive, perpetual, royalty-free, irrevocable, and fully
sub-licensable (throughout our group) right and licence to use, modify, reproduce, adapt, translate, publish, create derivative works from, distribute, display, and otherwise exploit such Member Generated Content (in whole or in
part), and, where applicable, you waive any moral or other rights you may have in the Member Generated Content you submit in favour of us. - 5.4. Whilst we do not control any material submitted by Members, we reserve the sole right (at our discretion), to edit, delete and modify any Member Generated Content submitted by you at any time without notice to you. Any
complaints regarding Member Generated Content should be sent to [email protected]. - 6. App Licence and Intellectual Property
- 6.1. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to enter and use the Ivy Membership Site, solely to support your use of the Ivy Membership Services.
- 6.2. All intellectual property rights in or arising out of or in connection with the Ivy Membership Site (including text, graphics, data, software, video, photographs and other videos, images, sound, logos and trade marks)
(collectively Ivy Content) and any other suggestions, feedback or other information provided by you (or any other party) relating to the Ivy Membership Services shall at all times be owned by us (or our licensors). You will have no
intellectual property rights in, or to the Ivy Membership Site and/or Ivy Membership Services other than the right to access and use the Ivy Membership Site and Ivy Membership Services in accordance with these Terms - 7. Links
- Where the Ivy Membership Site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as any kind of endorsement or
approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.

- 8. Disclaimers
- 8.1. ALTHOUGH WE MAKE REASONABLE EFFORTS TO KEEP THE IVY MEMBERSHIP SITE SAFE AND SECURE, WE CANNOT GUARANTEE THAT THE IVY MEMBERSHIP SITE IS FREE FROM VIRUSES AND/OR ANY OTHER HARMFUL CODE THAT MAY HAVE CONTAMINATING OR
DESTRUCTIVE ELEMENTS. IT IS THEREFORE YOUR RESPONSIBLY TO ENSURE YOU OBTAIN AND MAINTAIN ADEQUATE IT SECURITY SAFEGUARDS (INCLUDING ANTI-VIRUS SOFTWARE) TO ENSURE YOUR DEVICE IS PROTECTED. - 8.2. WHILST WE TRY TO MAKE SURE THAT ALL INFORMATION CONTAINED ON THE IVY MEMBERSHIP SITE (OTHER THAN ANY MEMBER-GENERATED CONTENT) IS ACCURATE AND CORRECT, YOU UNDERSTAND THAT THE ACCESS AND USE OF THE IVY MEMBERSHIP SITE
IS AT YOUR OWN RISK AND IS BEING PROVIDED TO YOU ON AN “AS IS” BASIS. WE CANNOT GUARANTEE THE IVY MEMBERSHIP SITE AND/OR THE IVY MEMBERSHIP SERVICES WILL BE CONTINUOUS, UNINTERRUPTED OR ERROR- FREE. CERTAIN PARTS, FEATURES OR
CONTENT OF THE IVY MEMBERSHIP SITE MAY AT TIMES BE UNAVAILABLE OR MAY BE WITHDRAWN, MODIFIED OR SUSPENDED BY US, AT OUR SOLE DISCRETION, WITHOUT NOTICE TO YOU. IN SUCH CIRCUMSTANCES, YOU HEREBY AGREE THAT WE WILL NOT BE LIABLE TO
YOU FOR ANY WITHDRAWAL, SUSPENSION, MODIFICATION OR UNAVAILABILITY OF THE IVY MEMBERSHIP SITE OR ANY PART, FEATURE OR CONTENT OF THE IVY MEMBERSHIP SITE. - 8.3. IN ADDITION TO THE ABOVE, WE MAKE NO REPRESENTATION OR WARRANTY AS TO THE ACCURACY, COMPLETENESS, RELIABILITY, CORRECTNESS, QUALITY, INTEGRITY, FITNESS FOR PURPOSE OR ORIGINALITY OF ANY CONTENT ON THE IVY MEMBERSHIP
SITE, AND TO THE FULLEST EXTEND PERMITTED BY LAW, ALL IMPLIED WARRANTIES, CONDITIONS AND OTHER TERMS OF ANY KIND ARE HEREBY EXCLUDED. WE ACCEPT NO LABILITY FOR AN LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOU USING THE IVY
MEMBERSHIP SITE, THE IVY MEMBERSHIP SERVICES OR ANY IVY CONTENT. - 8.4. NOTHING IN THESE TERMS SHALL LIMIT OR AFFECT ANY LOSS OR DAMAGE FOR DEATH OR PERSONAL INJURY AS A RESULT OF OUR NEGLIGENCE.
- 8.5. A PERSON WHO IS NOT A PARTY TO THIS AGREEMENT SHALL HAVE NO RIGHTS UNDER THE CONTRACT (RIGHTS OF THIRD PARTIES) ACT 1999 TO ENFORCE ANY OF ITS TERMS.
- 9. GOVERNING LAW
- These Terms, and any dispute between you and us regarding these Terms, the Ivy Membership Site or the Ivy Membership Services, shall be governed and dealt with by the laws of England and Wales. You and us both agree that the
courts of England and Wales will have exclusive jurisdiction

Terms of Service
- 1. Participating Restaurants
- 1.1. Part B of these Terms sets out how you, as a Member, may accumulate points and rewards every time you visit one of our participating restaurants (Participating Restaurants) by using your
Membership at the time of your visit. - 2. Membership Points
- 2.1. Your Membership is not a store card or a credit card, it is the way in which we show our appreciation of your loyalty by rewarding you every time you visit a Participating Restaurant. Please note that any points
you accumulate will not have any monetary value and cannot be exchanged for cash or credit. - 2.2. We reserve the right at any time to adjust your points and rewards where we have reason to suspect you have breached these Terms or that fraudulent activity has occurred. As mentioned in Part 1 above, you are
liable for any unauthorised use of your Membership. - 2.3. Members must be presented at the time of requesting the bill. Please note, the redemption or earning of points are not valid in conjunction with any other promotion.
- 2.4. Please note points may:
- 2.4.1. take up to 24 hours to show up on your Membership after visiting a Participating Restaurant; and
- 2.4.2. only be earnt on purchases of food & drink consumed within Participating Restaurants only. Points will not be earnt on any non-food & drink items (e.g. on any duties, taxes and/or any service charge(s)
that may be payable). If you choose to redeem points to pay for all or part of your bill, you are only eligible for points addition on the updated sub-total
- 2.5. When you collect points from a bill any points available may only be collected by a single Member. In other words, the full total of any points may not be given to more than one Member. The available points may not be
split or shared. - 2.6. You must collect points at the time you visit a Participating Restaurant and present your Membership. Except for special circumstances, we reserve the right to refuse to add points retrospectively to a Membership. If a
Member wishes to request for any points to be added retrospectively then this request must be made within 4 weeks of the date of the bill in question. - 2.7 All points will expire if a Membership has not been used to collect or redeem points in any 12 month period.
- 3. Prize Draws and Promotions
- 3.1. Only eligible Members may enter prize draws. We reserve the right to declare null and void any prize won by a Member who does not meet the eligibility criteria.
- 3.2. To be an eligible Member for a prize draw the entrant must:
- 3.2.1. be an active Member as defined within these Terms;
- 3.2.2. dine at a Participating Restaurant;
- 3.2.3. be at the relevant tier of Membership e.g. only green members are eligible to enter green prize draws;
- 3.2.4. provide details of Membership when booking or at the restaurant at the time of visiting;
- 3.2.5. be opted into marketing communications;
- 3.2.6. meet any further criteria unique to specific prizes.
- 3.3. Only one prize draw entry is allowed per eligible Member.
- 4. Green and Gold Leaf Membership
- 4.1. There are two Membership tiers of the Ivy Collection’s Membership scheme. Green and Gold Leaf Membership. Only eligible Green Leaf Members will become Gold Leaf Members. Further information on how to become a Gold Leaf
Member will be released by us in due course. Please keep a look out for this on the Ivy Membership Site. - 4.2. The Green Leaf Membership is the first tier of the Ivy Collection’s Membership scheme and is open to first time Members only.
- 4.3. You will receive one point for every £1 you spend at Participating Restaurants. By way of example, if a Member spends
£200 it will earn 200 points, which will equate to the Participating Restaurant credit worth £10 (e.g. every 20 points equates to £1 credit). - 5. Birthday Rewards
- 5.1 Valid Monday to Sunday, on date of booking, 7 days before and after your date of birth on your account
- 5.2 Reservation must be made 48 hours in advance to be able to redeem the complimentary dessert.
- 5.3 Your reward gives you one free birthday dessert (specified by site) when added to your booking when booked through the Ivy Premier Rewards app.
- 5.4 This dessert cannot be substituted for another product.
- 5.5 This offer is limited to one redemption per booking.
- 5.6 Offer must be added to your reservation at point of booking in the Ivy premier rewards app, it cannot be requested on site.
- 5.7 Only valid when dining at one of our specified sites in app.
- 5.8 This reward is limited to one dessert and can be used only once per year. Valid while stocks last. We cannot exchange this offer for a cash value.
- 5.9 This reward can’t be used in conjunction with any partner, premier rewards members only.
- 6. Miscellaneous
- 6.1. We reserve the right to change, modify and/or eliminate any points and/or rewards or any policy, FAQ, or guideline pertaining to the Ivy Collection’s Membership scheme at any time and in our sole discretion.
- 6.2. We reserve the right to “deactivate” and terminate your Membership if it has been inactive for three (3) consecutive years. Inactivity is defined as no points earned during such three (3) consecutive year period. In
the event that your Membership or account is deactivated or rendered inactive, all accrued points in your account are void.

platform, and other technology on the devices you use to access the Ivy Membership Site. - 3.1.4. Profile Data includes your username and password, preferences, feedback and survey responses.
- 3.1.5. Usage Data includes visit information about how you use the Ivy Membership Site, and Ivy Membership Services, including visit history.
- 3.1.6. Marketing and Communications Data includes your preferences in receiving marketing from us and our third parties and your communication preferences.
- 3.2. We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political
opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences. - 4. How we collect your personal data
- 4.1. We collect identity data and contact data when you set up your account in the Ivy Membership Site and when you contact us about the Ivy Membership Site to report issues or ask for
support. - 4.2. We collect technical data, profile data and usage data automatically when you use the Ivy Membership Site. This is data about your equipment, usage actions and patterns of usage. We may
receive technical data if you visit other websites using links within the Ivy Membership Site. - 4.3. We collect marketing and communications data when you select your marketing and communications preferences within the Ivy Membership Site.
- 4.4. We may anonymise your technical data, profile data and usage data in relation to your usage of the Ivy Membership Site.
- 5. How we use your personal data
- 5.1. We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:
